Welcome to Donny Pangle Photography. These Terms of Service ("Terms") govern your use of my website and photography services. By accessing my website or booking my services, you agree to be bound by these Terms. Please read them carefully.
1. Services Offered
Donny Pangle Photography provides professional photography services, including but not limited to:
Wedding photography
Senior portrait photography
Engagement sessions
Family portraits
Maternity and newborn photography
Event photography
Other photography services as mutually agreed upon
Specific details of each service, including deliverables, timelines, and pricing, will be outlined in individual service agreements or contracts.
2. Booking and Payment Terms
Booking Process
Sessions are booked on a first-come, first-served basis
A signed contract and retainer fee are required to secure your date
Your date is not reserved until both the contract and retainer are received
Payment Terms
Retainer fees are non-refundable and applied toward your total service cost
Payment schedules vary by service type and will be specified in your contract
Final payment is typically due before or on the day of service, unless otherwise agreed in writing
Accepted payment methods include credit/debit cards, PayPal, cash, or check
A $35 fee applies to any returned checks
Late payments may result in delayed delivery of final images
Additional Costs
Travel fees may apply for locations beyond the Tri-Cities area of Tennessee
Special requests beyond the agreed scope of services may incur additional charges
Print orders, albums, and other physical products are priced separately
3. Cancellation and Rescheduling
Client Cancellation
Retainer fees are non-refundable
Cancellations made more than 90 days before the scheduled session may be eligible for partial refund or credit, at my discretion
Cancellations made within 90 days of the scheduled session forfeit all payments made
No-shows or same-day cancellations forfeit all payments
Rescheduling
Rescheduling requests must be made at least 30 days before the scheduled session
One free reschedule is permitted; additional rescheduling may incur a fee
Rescheduling is subject to availability
Weather-related rescheduling for outdoor sessions will be accommodated without penalty
Photographer Cancellation
In the rare event I must cancel due to illness, emergency, or circumstances beyond my control, I will:
Provide as much notice as possible
Offer to reschedule at no additional cost
Provide a full refund if rescheduling is not possible or desired
Make reasonable efforts to secure a qualified replacement photographer if requested
4. Copyright and Image Ownership
Copyright Retention
I retain full copyright and ownership of all images created during your session
Images may not be reproduced, altered, or used for commercial purposes without my written permission
Copyright notices and watermarks may not be removed from images
Client Usage Rights
Upon receipt of final payment, you receive a non-exclusive license to:
Print images for personal use
Share images on personal social media accounts
Display images in your home
Provide images to friends and family for personal use
You may NOT:
Sell, license, or use images for commercial purposes
Enter images into competitions without permission
Alter images significantly (minor cropping and filtering for social media is acceptable)
Remove watermarks or copyright information
Photographer's Marketing Rights
Unless you expressly opt out in writing, I reserve the right to use images from your session for:
Portfolio and website display
Social media marketing
Print and online advertising
Photography competitions and publications
Educational purposes
Blog posts and promotional materials
If you wish to opt out of marketing use, please notify me in writing at the time of booking or within 14 days of your session.
5. Image Delivery and Retention
Delivery Timeline
Digital images are typically delivered within the timeframe specified in your contract
Standard delivery times: 2-4 weeks for portraits, 6-8 weeks for weddings
Delays may occur due to high demand, technical issues, or editing complexity
You will be notified of any significant delays
Delivery Method
Images are delivered electronically via online gallery (Sprout Studio or similar platform)
You are responsible for downloading your images within the specified timeframe
Physical delivery of prints, albums, or USB drives may be arranged for an additional fee
Image Retention
Digital images are retained on my systems for a period specified in your contract (typically 1-5 years)
After the retention period, images may be permanently deleted
It is your responsibility to back up and preserve your images
Extended storage may be available for an additional annual fee
Number of Images
The number of edited images delivered depends on the service package selected
Not all images captured during a session will be edited and delivered
I select the best images based on technical quality, composition, and storytelling
You will not receive RAW or unedited files unless specifically contracted
6. Model Release
By booking my services, you grant me permission to use photographs containing your likeness for professional purposes, including but not limited to:
Marketing and advertising
Portfolio display
Social media promotion
Website galleries
Photography competitions
If you wish to restrict the use of your images, you must notify me in writing and may be subject to a privacy fee.
Minors
For sessions involving minors, the parent or legal guardian grants permission for the child's likeness to be used as described above.
7. Session Conduct and Cooperation
Client Responsibilities
Arrive on time for scheduled sessions
Provide accurate contact and location information
Communicate any special requests or concerns in advance
Ensure cooperation of all session participants
Follow reasonable directions during the session
Provide appropriate clothing and preparation for the session type
Photographer's Rights
I reserve the right to:
Refuse service to anyone who is disrespectful, abusive, or uncooperative
End a session early if safety or professional conduct is compromised
Make final creative and technical decisions regarding photography
Alcohol and Substances
Clients and guests are expected to conduct themselves appropriately
I reserve the right to end sessions where excessive alcohol or substance use creates an unsafe or unmanageable environment
No refunds will be provided for sessions ended due to client misconduct
8. Liability and Limitations
Equipment Failure
While I maintain professional-grade backup equipment, I am not liable for:
Equipment failure or malfunction
Loss of images due to technical failure, theft, or data corruption
Inability to perform services due to circumstances beyond my control
In such cases, I will offer a refund or reschedule when possible, but am not liable for consequential damages.
Venue and Location Restrictions
I am not responsible for location permits, fees, or access restrictions
You are responsible for ensuring I have appropriate access and permissions
I am not liable for injuries occurring at locations beyond my control
Weather and Natural Events
Outdoor sessions are subject to weather conditions
I will work with you to reschedule in case of inclement weather
I am not liable for delays or cancellations due to weather, natural disasters, or acts of God
Limitation of Liability
My total liability for any claim arising from my services is limited to the amount you paid for those services. I am not liable for indirect, incidental, or consequential damages.
9. Guest Photographers and Personal Cameras
Professional Courtesy
Please inform wedding guests and family members to refrain from obstructing my work
Guest photographers and videographers must not interfere with my ability to capture images
I am not responsible for guests blocking shots or distracting subjects
Personal Cameras
Guests are welcome to take their own photos during appropriate times
During formal portrait sessions, I request that personal cameras be put away to maintain subject focus
10. Force Majeure
I am not liable for failure to perform services due to circumstances beyond my control, including but not limited to:
Natural disasters (hurricanes, floods, earthquakes)
Pandemics or public health emergencies
Government restrictions or venue closures
Severe illness or injury
Acts of war or terrorism
Other unforeseen emergencies
In such cases, I will work with you to reschedule or provide a refund as appropriate.
11. Editing and Artistic License
Creative Control
I maintain full creative control over editing and final image presentation
All images are edited according to my artistic style and professional standards
Specific editing requests will be considered but are not guaranteed
Color Correction and Retouching
Basic color correction and exposure adjustments are included
Minor retouching (blemish removal, teeth whitening) is included in most packages
Extensive retouching or manipulation may be available for an additional fee
Delivery Format
Images are delivered in high-resolution JPEG format suitable for printing
RAW files and unedited images are not provided unless specifically contracted
File sizes and formats are optimized for quality and usability
12. Print Releases and Third-Party Printing
Print Release
You receive a print release allowing you to print images through professional or consumer labs for personal use.
Print Quality Disclaimer
I am not responsible for print quality from third-party labs
Color variations may occur depending on the printer, paper, and calibration
I recommend professional labs for best results and can provide recommendations
13. Privacy and Confidentiality
Your personal information and session details are kept confidential according to my Privacy Policy. I will not share your contact information with third parties for marketing purposes.
14. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Tennessee.
Dispute Resolution Process
In the event of a dispute:
1. First, contact me directly to discuss and resolve the issue
2. If unresolved, we agree to attempt mediation before pursuing legal action
3. Any legal action must be brought in the courts of Tennessee
Limitation Period
Any claims must be brought within one year of the date the services were provided.
15. Entire Agreement
Your service contract, these Terms of Service, and my Privacy Policy constitute the entire agreement between you and Donny Pangle Photography. Verbal agreements or promises not documented in writing are not binding.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
17. Modifications
I reserve the right to modify these Terms at any time. Changes will be posted on my website with an updated effective date. Continued use of my services after changes constitutes acceptance of the modified Terms.
For bookings made before changes take effect, the Terms in place at the time of booking will apply.
